What is the Tournament?
The Tournament is a weekly competition beginning April 19, 2010 celebrating the funniest and most popular original comedy videos recently uploaded to Atom.com ("Atom").
How does one enter the Tournament?
Entering the Tournament is simple. Just
upload an original comedy video to Atom.com and in the process, agree to our
User Content Submission Agreement,
Terms of Use, and these Official Rules. Video specifications including video formats and file size limits are communicated during the
upload process.
What are the prizes and how do videos win?
There are three ways to win recognition and prizes in the Tournament.

Top Plays -- Each week, beginning at 12:10 am Monday morning and continuing until 12:09 am the following Sunday night (all times Eastern), Atom tracks play counts for each eligible video upload. The eligible videos with the 3 highest play counts during the week win our "Top Plays" competition!
1st place prize: $500 and Atom swag (t-shirt, hat)
2nd place prize: $250 and Atom swag (t-shirt, hat)
3rd place prize: $100 and Atom swag (t-shirt, hat)

Atom Picks -- Atom editors and development execs are always on the lookout for Tournament videos that meet our highest quality standards and our current distribution needs. These videos will be selected as "Atom Picks", earning "Pro" status on Atom and an Atom distribution deal. Any eligible video can be selected as an Atom Pick regardless of its play count. The number of Atom Picks will vary from week to week, and Atom is not obligated to make an Atom Pick every week.
PRIZE: $500, Atom swag, (t-shirt, hat) and an Atom distribution contract enabling further distribution of the video on multiple distribution platforms including the Web, mobile phones, and television (for example, the "Atom TV" latenight program on Comedy Central.

Shout Outs -- Atom editors may periodically choose to acknowledge additional funny videos with a "Shout Out" badge (e.g.: Sexy, WTF, Gross, Best Low Budget, etc) on the Tournament page.

New winners will be announced on Atom's Tournament page each Monday (or Tuesday if a holiday gets in the way). Potential winners will also be contacted, using the email address provided to Atom.com during registration, and at that time potential winners will be asked to complete a set of paperwork including an affidavit of eligibility. Any potential winner who does not completely and truthfully fill out the affidavit of eligibility and other paperwork will be disqualified.
About play count tracking
Atom encourages you to increase your play count by promoting your Tournament-eligible video across the web. Post it to your Facebook, Tweet it, embed it in blogs, email it to your friends. You know that your competitors will be doing it.
Video plays are counted using Atom's internal systems, which tracks plays to the video on the Atom.com site, and plays generated through the use of Atom's embeddable video player on other sites. For purposes of the weekly "Top Plays" category, play counts are reset each week to zero for all eligible videos.
Do not artificially inflate your play count by (for example) using software or web services to automatically generate a ton of plays in a short period of time. If we suspect that play count inflation is occurring, we reserve the right to remove the suspect video from eligibility and revoke your Atom membership.
Eligibility
Atom is seeking original short comedy videos, e.g. funny videos you created or own the rights to, including sketch comedy, spoofs, parody, short films, animation, etc.
To enter an original comedy video in the Tournament, simply
upload it to Atom.com. Newly uploaded comedy videos uploaded on or after April 19, 2010 are eligible to compete in 3 weekly Tournaments. If you upload mid-week, that counts as your first Tournament even though it’s a partial week. While eligible, your video can win any Tournament - try to win all 3! Only residents of the United States and Canada are eligible to win prizes. Only videos in English, with English subtitles or with no dialogue are eligible to win.
In order to
upload a video you must first become a registered member of Atom.com, a process that requires you to agree to our
Terms of Use and
User Content Submission Agreement. Registration is free, and open to users at least 13 years old. If you are under the age of 18 at the time your video wins, you must have your parent's permission to win a prize, and the prize will be awarded to your parent.
The first time you win a prize in any calendar year, the prize claim procedure requires you to complete an Affidavit of Eligibility/ Release of Liability and Publicity Release Form (collectively "Affidavit/Release"). You will also be required to provide proof of age and residency. If prizing exceeds $599 in a calendar year and you are a US resident, you will need to provide your Social Security number and you will be sent a 1099. Void where restricted or prohibited by law.
Atom reserves the right to remove a video from Tournament eligibility for any reason. Examples of videos that may be removed from participation include:
a. videos with artificially inflated play counts (more on this below)
b. videos that are non-comedic
c. videos that are non-original, for example promotional videos
d. videos that are lewd, illegal or do not otherwise comply with Atom standards
e. videos that are already under contract to Atom.com in another capacity
f. videos that are participating in Atom’s
Star Wars Fan Movie Challenge
g. videos that have already competed in three tournaments.
Additional Important Terms
A. By participating in activities at Atom.com and/or the acceptance of any prize, the User agrees to be bound by the Official Rules, the
Terms of Use, and the
User Content Submission Agreement and accepts the decisions of Atom.com as final and binding.
B. Employees of Viacom International Inc., Atom Digital, Inc., Extra Mile Marketing, their subsidiaries, affiliates, parent company, sales representatives, agents, advertising and promotion agencies or any other agencies or entities involved with the development or management of Atom.com,and members of their respective families (parents, siblings, children, and spouse and their respective spouses) and/or those residing in the same household (whether related or not) of each of the above are not eligible to win a prize. Void where prohibited or restricted by law.
C. No substitution, transfer or assignment of prizes is permitted, other than as stated herein. In the event of non-compliance with any of the requirements for the completion and return of an Affidavit/Release, the prize is forfeited and will not be awarded. If prize/prize notification is returned as undeliverable, such prize is forfeited and will not be awarded. Unclaimed prizes will not be awarded.
D. All cash prize amounts are expressed in US dollars and awarded in US dollars by check. Any prize winners who are residents of Canada resident will be awarded a cash equivalent prize for any swag.
E. All times references are expressed as US Eastern Time.
F. Any and all United States tax liability resulting from a winner's receipt of any prize is the responsibility of the winner. Canadian winners will have approximated taxes withheld from cash prizes and the value of swag.
G. Winners will be notified by e-mail within approximately five (5) business days of their selection. If winners do not respond within ten (10) business days of e-mail notification, they may be deemed ineligible to receive prizes.
H. Atom pick winners will be required to sign a license agreement and provide supporting documentation.
I. By entering, participating or accepting the prize, winner releases and holds harmless Atom and Extra Mile Marketing and the directors, officers, employees or agents of any of the above organizations from any and all liability and will be held harmless by winner and his/her heirs and executors for any injury including personal injury, death, loss or damages of any kind, arising from participation in or in connection with acceptance, possession, use and/or misuse of any prize or participation or any claims based on right of publicity/right of privacy.
J. Except where prohibited, by accepting prize, the winner grants Atom the right to use and publish his/her photograph, likeness, name, city and state of residence and/or likeness for advertising and promotional purposes in any media in connection with the Tournament without limitation and without additional compensation.
K. At the conclusion of any given Tournament prize winning cycle and the selection or naming of the published winner(s) for that week, Atom.com has the right to modify any rule relating to the Tournament or discontinue the Tournament entirely.
L. Atom.com is not responsible for technical, hardware, software, telephone or other communications malfunctions, errors or failures of any kind, lost or unavailable network connections, web site, Internet, or ISP availability, unauthorized human intervention, traffic congestion, incomplete or inaccurate capture of entry information (regardless of cause) or failed, incomplete, garbled, jumbled or delayed computer transmissions which may limit one's ability to participate in site activity or prize winning activity, including any injury or damage to participant's or any other person's computer. Atom.com is not responsible for interrupted or unavailable network, server or other connections, miscommunications, failed phone or computer hardware or software or telephone transmissions or technical failures, garbled or jumbled transmissions or other errors of any kind, whether human, mechanical or electronic.
M. A list of prizewinners is posted at Atom.com. Additionally, you can request a list of the winners for any given month by sending a self addressed stamped envelope to: Atom.com Tournament Winners, PO Box 12487, Scottsdale, AZ 85267-2487. All requests for winner's lists received by the last calendar day of each month will receive the list of winners for that month.
