Atom bills you upfront for platform services ($249 platform fee). Your attorney bills you directly for legal services ($250 for the first class, $100 for each additional class) and USPTO fees ($350 base application fee per class). Atom does not collect or remit attorney fees.
The $249 platform fee covers a federal & common law search, Up to 3 Premium Trademark Reports with risk analysis, 12 months of full brand monitoring, and the workflow tools that guide your filing from start to finish.
The attorney's fee covers correct class identification, legal review & strategy, preparing and filing the application, serving as attorney of record, and post-filing support such as deadline monitoring, responding to non-substantive Office Actions, advice on enforcing and properly using your trademark, and up to 3 cease & desist letters (first 12 months).
If you've already filed a trademark application, an independent attorney can still help — reviewing your application status, responding to Office Actions, and advising on next steps. You can also use Atom's monitoring tools to keep watch over your brand.
No. The USPTO base application fee is $350 per class of goods/services, billed by your attorney along with legal fees. Your attorney will help you determine your classes before these fees apply.
